$1.3M Settlement Secured for Accident Victim

In a recent case, our client, a 56 year-old Mexican immigrant, had spent a fun-filled day with his wife and granddaughter at Gatorland in Orlando, FL. The traffic heading home was stop-and-go and our client’s vehicle was violently rear-ended by a tractor-trailer, the driver of which was operating his truck on a suspended license. Our client was rushed to the emergency room complaining of severe back and neck pain.

He had undergone several back surgeries prior to this incident which just served to exacerbate the existing damage. As a result of the collision, our client was subject to spinal injections to treat the pain. Once those were found to be unsuccessful, he underwent an anterior cervical micro-discectomy. This procedure is used to relieve back pain and calls for the removal of the spinal disc that is causing the compression and pain. His injuries also called for a revision of the prior surgeries performed on his spine and it is probable that he will require future surgeries to manage pain and aid with continued mobility.

Though the defendant’s insurance carrier attempted to dispute the injuries as pre-existing and attributed the surgery to the previous injury, the Steinger, Greene & Feiner attorneys were able to show the truck driver’s clear liability in the accident and how that liability translated to the injuries sustained by our client. The total settlement amount was $1.45M with $1.3M going to our client and $150K assigned to the client’s wife and granddaughter who were also involved in the accident.
