14-year battle over

March 9, 2012

A 32-year-old Sunrise man will receive $10.75 million to pay for lifetime medical care, the Florida Legislature in Tallahassee said Thursday, according to the Orlando Sentinel.

After a 14-year battle between the man and the Broward Sheriff’s Office, and four years of debate in the legislature, the Florida Legislature signed a bill that will give the man the money to pay his medical bills and living expenses.

The man’s accident resulted from a 1998 car crash caused by a speeding Broward sheriff’s deputy who was late for work. The battle had left the man broke and on Medicaid.

The House and the Senate had gotten into a fight over how much to pay the attorneys and lobbyists who represented the man through the trial and the legislative process.

Fearing that the bill would continue to ping-pong between the House and Senate, the family’s attorneys and the lobbyists agreed to waive their fees. The bill was then amended to say that no fees would be paid and the man would receive the entire sum.

The money will be put into a trust fund to pay for the man’s care. Because of the accident, he is confined to a wheelchair and permanently brain damaged. He can speak with some difficulty, but is difficult to understand.
